OpenRTB 2.6.202409 IP Exclusion Notice

As you may know, Section 2.3.2 of Tech Lab’s Intellectual Property Rights Policy provides for Exclusion Notices to be filed with the Tech Lab by a Working Group Participant. The Programmatic Supply Chain Working Group published the following Draft Specification: OpenRTB 2.6-202409. We received an Exclusion Notice during the patent notification period. Tech Lab makes no representation as to the validity of such Exclusion Notices.

  1. What is an IP Exclusion Notice?

When a member company has patents or published patent applications they believe may be infringed upon by the release of a Tech Lab specification, they may notify us during the public comment/patent notification period.  For a further explanation of Exclusion Notices, please see the IPR Policy.

Please discuss what the published Exclusion Notice(s) mean for your company with your legal counsel. 

  1. Does this impact my implementation of the new attributes in OpenRTB 2.6-202409?

Companies wishing to send and/or receive the signals contained in OpenRTB 2.6-202409 will need to work with their legal counsel to determine the best course of action, including whether they believe an Exclusion Notice is valid.

Tech Lab has published the Exclusion Notice in full. Tech Lab does not have further information concerning the basis for exclusion.

The notice applies to the most recent release of OpenRTB, 2.6.202409. It does not apply retroactively.

  1. How does the Exclusion Notice apply to future releases of OpenRTB?

The Exclusion Notice will apply to each version of OpenRTB that uses the objects and attributes released in 2.6.202409.
